By accessing the Tekyerden website and the services offered by Tekyerden, you are deemed to have accepted the terms of use set out below. If you do not accept these terms, you must not use the platform.

1. Parties

These Terms of Use (the "Agreement") are entered into between:

and the natural or legal person using the platform (the "User").

2. Scope of the Service

Tekyerden is a platform that may provide:

• Payment processes,
• Sales operations,
• Customer management,
• AI-assisted business processes,
• Financial integrations,
• Operations and management tools,

as a cloud-based SaaS (Software as a Service) solution.

Tekyerden is not a bank, an electronic money institution or a payment institution. Financial services and payment infrastructure may be provided through licensed business partners and integration providers.

3. Account Creation and Use

When using the platform, the User is responsible for:

• Providing accurate and up-to-date information,
• Maintaining the security of their account,
• Not sharing their user credentials with third parties,
• Acting in compliance with applicable legislation,

and is bound by these obligations.

The User is responsible for all transactions carried out through their account.

4. Prohibited Uses

The User may not engage in the following activities:

• Carrying out unlawful transactions
• Conducting fraudulent transactions or fraud
• Using software or code that may harm the system
• Attempting unauthorized access
• Producing spam, misleading or malicious content
• Infringing the rights of third parties
• Misusing AI systems

Tekyerden reserves the right to suspend or terminate the account if it detects any such activity.

5. Artificial Intelligence Services

The AI-assisted features offered within Tekyerden are provided for information, automation and operational support purposes.

Content generated by AI systems:

• May contain errors,
• May produce incomplete or outdated information,
• Does not replace a final decision.

The User accepts that they bear full responsibility for the use of AI outputs.

6. Payment and Financial Services

Tekyerden may provide technology infrastructure and integration services relating to payment processes.

Payment transactions may be carried out through:

• Licensed payment institutions,
• Banks,
• Electronic money institutions,
• Financial integration providers.

as applicable.

Tekyerden:

• Is not a payment institution,
• Does not hold user funds,
• Is not a provider of credit or financing.

Tekyerden cannot be held directly liable for interruptions in financial transactions caused by banks, infrastructure or third parties.

7. Intellectual Property Rights

All of the following belonging to the platform:

• Software,
• Designs,
• Trademarks,
• Logos,
• Content,
• Interfaces,
• Algorithms

are the property of Tekyerden Teknoloji A.Ş.

The User may not copy, reproduce or use this content for commercial purposes without Tekyerden's written permission.

8. Service Continuity

Tekyerden makes reasonable efforts to keep the platform running without interruption. However, the service may be interrupted due to:

• Maintenance work,
• Technical problems,
• Third-party service outages,
• Security issues,
• Internet infrastructure problems.

Tekyerden does not guarantee uninterrupted service.

9. Limitation of Liability

With respect to:

• Indirect damages,
• Data loss,
• Loss of revenue,
• Loss of business,
• Third-party service outages,
• Consequences arising from AI outputs,

Tekyerden cannot be held liable.

The User accepts that they use the platform at their own risk.

10. Third-Party Services

Third-party services and integrations may be used within the platform. These may include, for example:

• Payment infrastructure,
• Cloud services,
• AI services,
• Messaging services,
• Analytics tools,

among others.

The terms of use of these services apply separately.

11. Suspension and Termination of Accounts

Tekyerden may suspend or terminate a user account in the following cases:

• Breach of the terms of use,
• Suspicion of unlawful activity,
• Emergence of a security risk,
• Detection of misuse.

12. Right to Amend

Tekyerden reserves the right to amend these Terms of Use. The current version enters into force on the date it is published on the website.

13. Governing Law and Jurisdiction

This agreement is governed by the laws of the Republic of Turkey.

The Istanbul Central (Çağlayan) Courts and Enforcement Offices have jurisdiction over any disputes.
